What state is in charge of child support modifications? The state the original order was made or the state the child is currently living?

Back in 2000, a court order for child support was made in the state of Massachusetts. For the past 16 years I have been paying every week, on time. I have no arrears.

About 11 years ago the custodial parent and my son moved out of state from Mass to New Hampshire. My son is going to be turning 18 at the end of April. I received a letter from the Massachusetts child support division saying the child support will continue until 2019.

Since my son and his mom do not live in that state anymore, can I ask for the court order to be transferred to New Hampshire? New Hampshire, I believe, stops child support at the age of 18 or after high school graduation. Who would I contact about this?

    Read the original order and call the child support agency in MA.

    They should be able to explain how they have interpreted the end to be in 2019, or tell you what circumstances qualify for extended payments.

    If you have to have the order modified, it would have to go back to the original court that issued it, although it may end up being transferred to the NH county where they live now. She should have asked permission to move of the judge, who would likely have transferred the case to NH. For now, ask MA CS why they think it would go to 2019 - they should be able to tell you, or correct it, unless your kid stayed back.
