Ebay dispute question?

Hey guys,

I recently purchased an makeup palette on ebay. The seller said it was being sold at a discount because there may be a dent or two in the packaging, which was fine with me, because I wanted the product, not necessarily the packaging. Anyway, the palette arrived and right away it looked "off" to me. I searched the internet for information, and it turns out I was sent a counterfeit product. The original makeup palette is $60 in Canada, and I paid about $45 on ebay... for a fake of the original.

The same day it arrived I opened a dispute on ebay/paypal and emailed the seller. I requested a refund and said she had sent me a fake product. Her reply basically said the distributor she gets the palettes from said they were factory seconds (aka dents or whatever to make them cheaper) and that they don't accept returns on makeup for hygiene reasons so if I want my money back, I have to mail it back to the UK, unused, basically in untouched condition. (Obviously she's just gonna resell it).

So I emailed back and asked her to pay for shipping because it's going to cost me a lot to send it to the UK and as a seller it is her responsibility to know what product she is selling and whether or not it is a genuine product. She just replied and basically said she is not responsible to pay for shipping so I better find the cheapest way I can to send it and once she gets it, she'll issue a refund.

So basically, I am looking on advice as to what to do. I'm just really ticked over the whole situation. I'm scared that if I send it back, I have no way to prove it and she won't give me my money as she never even apologized and has been quite abrupt, so I don't really trust her. What if I had tried the makeup and the then realized it was fake.. could I not have got my money back? When I was openning the package the box got a small rip on it.. is that reason not to give me my money back? Should I contact the other buyers who left positive reviews and obviously don't realize this is a fake to tell them it is? I don't know if I should escalate the claim or not as it is supposed to close 20 days after it opens and I don't want my dispute to close before I get my refund and then I'm screwed.

Sorry this is so long! I know I need to be a smarter shopper next time, but any advice would be great! Thanks!!

    Just make sure you send it back to the Seller (not to a different address/location/Country)

    As long as you return it using a tracked method Paypal will refund ALL your original payment.

    The Seller cannot be forced to pay return shipping unfortunately

    If you have the equivalent of our UK Trading Standards you can take it there and they can verify if it is fake. If it is fake they will destroy it and give you a letter to input into the dispute (saving you shipping it back at your expense and the seller reselling)

    Once you have your proof I would confront the seller and tell them in no uncertain terms that it is illegal for them to sell fakes (I would use this tactic if I was out of pocket for return shipping)

    There are probably government offices in both Canada and the UK that deal with counterfeit products. You might even contact interpol considering this was international. In the US counterfeit products are taken very seriously; I'm sure it's similar in Canada and the UK. This lady will be in quite a bit of trouble if you report her to the right people.
