Child support question.?
I pay child support for a previous relationship. I have remarried 10 years ago and have two other children now. Now me and my current wife are having problems and I'm scared to death of what will happen if I have to pay child support for both. What will be my worst case scenario. I've heard that they can only garnish 50% of paycheck is that true. I will be so screwed and not be left any money to surrvive and live. I certainly could not afford to even rent an apartment and pay the car note.

Don't know what state you live in but when I was getting my child support from my ex husband, (his check was garnished as well) it was only 1/3 of his pay check. He also had another child from a previous marriage that he was paying child support to part time and then we had our 2. The only reason your check would be garnished is because you will not pay the support. If you pay it your self, it will not be garnished. You see I gave my ex a chance to pay it him self and he wouldn't so I had his check garnished.

Well, you're situation is grim. You don't mention the ages of the children so I'm going to give you one piece of advise, If it comes down to paying child support for both marriages the one thing you can do to help the money issue is try to settle out of court. Find out what the bottom line is on the amount and go from there. I have a friend in your situation. He and his X has been able to establish a fair price per month. On occassion, she calls him and wants more. However settling this out of court saves a lot of money that would of been spent on lawyers and court fees.

In NC they can only take the max of 50%. Then they would divide the money between the two women for the kids. Not any more money from you, just less to the two mothers.
