Is smoking marijuana a violation of probation even tho it is legal for anyone above the age of twenty one?

    The fact that it is legal is irrelevant. Alcohol is legal for someone over 21, but prohibiting it is common on probation. Another common example would be prohibiting sex offenders to have internet access.

    Your SPECIFIC probation should cover this.  It it doesn't, ask.

    Terms of your probation spells it out. Alcohol is legal too and it is prohibited for many on probation.

    I'm not an expert.  Your P.O. is the only one who can answer this question authoritatively.

    But I would say it depends.  If you're on probation on a drug charge, then probably not.

    If you're on probation from a federal violation then you're breaking your parole. Use of marijuana is a federal offense.
