Does breed specific legislation violate the Americans with Disabilities Act?
Reposting a question that mysteriously disappeared.
Under the ADA, any breed of dog can be utilized as a service animal. And SD teams cannot be discriminated against on the basis of fear or allergies. To the ADA, a service dog's breed is no different from a wheelchair's model and color. But BSL is sometimes used as an excuse to discriminate against SD teams, and there is never any wording in BSL to prevent such discrimination. Does that make all BSL a violation of the ADA and of disabled Americans' civil rights?

Actually, the ADA says ABSOLUTELY NOTHING about breeds of service animals. It doesn't even specifically acknowledge that service animals CAN exist.
That said, the ADA requires REASONABLE accommodations and not all accommodations are reasonable.
There are cases where it is 100% legal to ban certified service animals of all kinds.

No but airlines have more freedom to make discretions.
If a wheelchair wont fit in the cabin, it goes in cargo hold and the person is goven assitance to their seat.
If they feel the dog poses a potential hazard, he can go in cargo hold in a crate and the owner will get any needed assistance as well.
It isnt illegal discrimination, since hes getting the SAME treatment as another disabled person whos medical equipment doesnt belong/wont fit in cabin.
