Is encouraging violence protected under free speech in canada?

    There are laws against incitement -- encouraging or aiding someone to commit a crime. There is also conspiracy to commit a crime -- which goes beyond incitement to providing the means to otherwise commit a crime.

    However, violence itself illegal and therefore encouraging someone to engage in violence isn't necessarily illegal unless that violence was part of a criminal act. You can encourage people to play football, to check someone in a hockey game, hit someone at a boxing match, or to choke someone at a judo tournament. It would be incitement if you encouraged someone to assault someone on the street, to steal something, or to not pay their taxes. If you actively helped someone commit assault (say giving them the address of someone, when they would be home, etc.), helped someone steal (say gave them a key to store), or aiding someone in not paying their taxes (say providing phoney T4 slips) that would then be conspiracy.
