Question about FMLA leave...?

I work for a private medical office of only 8 employees, in Massachusetts. I need to take time off for shoulder surgery. The US department of employment states that only people working with at least 50 employees are eligible, tell me is this true? Can I get FMLA although we do not have 50 employees? I have worked here for 18 months. Thank you.

    It's a hardship on small businesses to hold jobs for up to 12 weeks while an employee is gone, therefore the government doesn't make those with less than 50 employees follow FMLA guidelines. You're out of luck unless your employer simply wants to hold your job.

    The FMLA does not apply to this size company. However, there may be a similar state law that does apply. I am not familiar with Massachsetts law on this, so you may wish to contact a local lawyer on this.

    No, for a company to qualify under FMLA they must have 50 employees working for them.

    (FMLA is unpaid job protection leave)

    Federal and your state does not give you any protection.

    You are out of luck.

    Try to work a deal with your employer.

    No. You can not. however you could challenge the law in court.
