Restraing Order?

Can you get a restraining order for verbal and emotional abuse? The police were called and children were present.

Update:

No there were no charges laid. This was not an isolated situation, the police have been called before. This time it was my 12 year old who called them though.

    Most states have an anti-stalking and/or protection from abuse statute. The local district (or county) attorney's office usually has staff who assist people with this. In the absence of this, there are often social service organizations who can assist and provide assistance with people who are being abused.

    Verbal and/or emotional abuse is a form of abuse, and can (depending on the state) result in a protection from abuse order, and/or a no contact order.

    I suggest that you contact your local district attorney's office and ask to speak with the victim/witness coordinator and if there isn't any such entity, then ask if there are any resources in the community to help. They staff there should be able to direct you accordingly.

    You can also consult an attorney licensed in your state. For a referral to an attorney, contact your local or state bar association.

    Anyone can sue anyone for anything. But the thing is will you win? Go talk to the DA's office they will assist you in this matter. He will tell you if you have a chance or not at getting a restraining order. When the police where called were there any charges? If so this will help you. Good luck!

    Was this a one-time incident, or have there been multiple incidences of abuse? It could be considered as harrassment, which can be grounds for a restraining order.

    not for emotional or verbal abuse. i do not think u can get a restraining order for that. however ask u r da

    i think so because ur children were therwe. if they were crusing u have a good chance of getting the testraing order
